Terms of Service

These Terms of Service ("Terms") are an agreement between you and HALE Health, Inc. ("HALE," "we," "us") and govern your use of the HALE mobile app (the "App"), a nicotine-cessation app that helps you quit with streaks, a craving SOS toolkit, an AI coach, and an accountability buddy. By downloading or using the App, you agree to these Terms. If you don't agree, please don't use the App.

Who can use HALE

HALE is intended only for adults 21 years of age or older. You must be old enough to form a binding contract to use the App. The App is provided for general wellness and education and is not a medical device, not medical advice, and not a substitute for professional care. If you are in crisis, contact the 988 Suicide & Crisis Lifeline (call or text 988 in the US) or your local emergency number.

Your account

You can start using HALE without an email, password, or any personal information. The App begins with an anonymous account tied to your device. You are responsible for the activity on your device and for keeping your device secure. You can delete your account and all of its data at any time from within the App (You → Delete Account), which permanently removes your account and the personal content tied to it.

Free features and HALE+

The core of HALE is free: buddy pairing, streaks, daily check-ins, and the full craving SOS toolkit. HALE+ is an optional, auto-renewable subscription that unlocks unlimited Sage coaching, full health analytics, and multiple squads.

Subscription, pricing, and free trial

HALE+ is offered as an auto-renewable subscription on the following plans:

Both plans include a 3-day free trial on the plan you choose. You will not be charged during the trial. Prices are in US dollars and may vary by region and currency; the exact price, currency, billing period, and any introductory offer are always shown on the purchase screen in the App before you confirm. Prices may change in the future, and any change will be disclosed to you in advance as required by the App Store.

Billing, auto-renewal, and cancellation

Payment is charged to your Apple ID account at confirmation of purchase. If you start with the 3-day free trial, payment is charged when the trial ends unless you cancel at least 24 hours before the trial ends.

Your subscription automatically renews unless you turn off auto-renewal. It renews at the then-current price for the same period (yearly or monthly), and your Apple ID account is charged within 24 hours prior to the end of the current period. You can manage or cancel your subscription, and turn off auto-renewal, at any time in your device's Settings → your name (Apple ID) → Subscriptions. Cancellation takes effect at the end of the current billing period, and you keep HALE+ access until then.

Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

Refunds

All HALE+ purchases are processed by Apple through the App Store, and Apple is responsible for billing and refunds. We do not collect your payment details and cannot directly issue refunds for App Store purchases. To request a refund, use Apple's process at reportaproblem.apple.com. Refunds are subject to Apple's policies and applicable law.

Acceptable use

You agree to use HALE only for lawful, personal, non-commercial purposes. You agree not to misuse the App, interfere with its operation, attempt to access it in unauthorized ways, reverse engineer it except where permitted by law, harass other users (including buddies and squad members), or upload content that is unlawful, abusive, or harmful. We may suspend or terminate access that violates these Terms.

Sage AI coach

Sage offers general, evidence-informed support for quitting nicotine. It is not a licensed clinician and does not provide medical advice, diagnosis, or treatment. Use your own judgment, and consult a qualified professional for medical decisions. Sage's responses are generated by AI and may be inaccurate or incomplete.

Intellectual property

HALE and its content, design, logos, and software are owned by HALE Health, Inc. or our licensors and are protected by law. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the App for its intended purpose. You retain ownership of the content you create; you grant us the rights needed to operate the App and provide the features you use.

Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that it will help you quit. Results vary by individual.

Limitation of liability

To the fullest extent permitted by law, HALE Health, Inc. and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the 12 months before the claim.

Apple App Store terms

If you download the App from the Apple App Store, you acknowledge that these Terms are between you and HALE only, not Apple, and that Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also comply with the Apple Media Services Terms and Conditions, including the Usage Rules.

Changes to these Terms

We may update these Terms from time to time. We'll post the new version with a new effective date, and for significant changes we'll let you know in the App. Your continued use of the App after changes take effect means you accept the updated Terms.

Termination

You may stop using the App and delete your account at any time. We may suspend or end your access if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws rules, except where mandatory local consumer law applies to you.
